The Federal Shariat Court has declared in a decision that the state has the right to determine the minimum age for marriage.
The Federal Shariat Court ruled on a petition related to the minimum age of marriage in the Sindh Child Restraint Marriage Act, 2013.
The court rejected the plea of Ali Azhar, ex-husband of minor girl Arzoo Fatima from Karachi.
In its decision, the Federal Shariat Court says that the state has the right to determine the minimum age for marriage, this action of the state does not conflict with Islamic laws.
Arzoo Fatima accepted Islam and married Ali Azhar by choice, the Sindh High Court declared Arzoo Fatima’s marriage with Ali Azhar illegal due to her young age.
Ali Azhar had challenged Sections 2A and 8 of the Sindh Child Restraint Marriage Act, under which the minimum age of marriage in Sindh is 18 years.
